Important Notice for Employers With 10 or More Employees in Delaware

 

Effective January 1st, 2026, Delaware is implementing Paid Family and Medical leave (PFML), which is a state-mandated benefit for workers. The PFML benefit allows time off for qualifying events. This includes Parental Leave, Medical Leave, Family Caregiving Leave, and Military Exigency Leave.

Employers with 10 or more employees in Delaware are required to provide this benefit to their workers. Employers can choose to opt-in to the state plan or can elect to provide an approved private plan through an insurance carrier. If opting in to the state plan, contributions will begin on 1/1/2025. If electing to provide a private plan, premium payments will not begin until 1/1/2026 with most insurance carriers. Employers must opt-in or opt-out of the state plan by 12/1/2024.
